If someone that was originally sentenced to death but gets the sentence commuted to life can that be reversed?
sure, give me 5 minutes alone slimeball.
though believe protected sentence increases 'ex post facto' laws. i.e. not allowed convicted crime not crime @ time of offense. if follows principal applies sentencing, i.e. our existing sentence cannot 'upgraded' change in law.
passing ban on capital punishment, include clause commute current death sentences lower punishment life imprisonment & once lower sentence in effect cannot 'ex post factoed' higher sentence should state reinstate higher penalty.
or there law in effect protect them this?
