Tax question, someone claimed me illegally?
file paper return mail. can't e-file because has claimed you. irs investigate , award exemption according law.
b/f may or may not able claim you, if can't can claim yourself.
landlord wrong. can claim unrelated person dependent under qualifying relative rule if of following conditions met:
1. person citizen or resident of us, canada or mexico.
2. person not qualifying child of taxpayer.
3. person not file joint return taxpayer.
4. person lived in home entire tax year.
5. person had less personal exemption amount ($3,650 2009 & 2010) in gross income (excluding non-taxable social security) entire year. gross income includes income sources before deductions whatsoever, including normal business expense deductions.
6. person received more 50% of total support entire year.
7. there no state law or local law or ordinance prohibits cohabitation. such law or ordinance, if unenforced, kills exemption. mississippi, virginia, west virginia, florida, north dakota , michigan still have laws prohibit cohabitation number of cities, towns , counties throughout country.
note if can claim you, gets exemption. no head of household, no eic, no child tax credit, etc.

edit: ok, added information can file hoh because of child if paid more half of cost of maintaining home. can claim other tax benefits (eic, ctc, etc.) if otherwise eligible because child child.
my mother claimed me on taxes , haven't lived on 2 years, in fact have restraining order on her! stay @ home mom last year , boyfriend going claim me, , today found out cant because mother did. know can this?
