when in us, visa on? how many years had been in us?

if in on h1b visa 1/1 8/1/2006, irs consider resident alien entire year, unless elected terminate residency when left. resident return uses worldwide income, has standard deduction , credit taxes paid india on same income. dual status return include income through date of departure, has no standard deduction.
